European insect industry welcomes CJEU clarification

The International Platform of Insects for Food and Feed (IPIFF), the European association representing actors involved in the production and marketing of insects, welcomes the judgment of the Court of Justice of the European Union ( CJEU), issued at the end of 2020, which specifies that “food consisting of whole animals such as“ whole insects ”does not fall within the scope of Regulation (EC) No. 258/97 on novel foods (Novel Foods) ”. According to Christophe Derrien, the general secretary of IPIFF, "this decision is important because it can put an end to the uncertainty faced by insect producers who marketed such products before January 1, 2018". While the new legislation on novel foods (namely Regulation (EC) No. 2285/2015) which entered into force on January 1, 2018 clarifies that these products have been subject to EU authorization since January 2018; the previous text did not impose such an obligation. This question is now clarified by the CJEU. Operators who have marketed these products, in accordance with EU food safety rules, can continue their activity until the entry into force of the first authorizations for novel foods, as permitted by the new EU legislation on novel foods. novel foods (via the transitional measures provided for in the text). "Although this judgment is an important step for the development of the European edible insect sector, the authorizations of novel foods remain the most critical step towards wide access to the EU market for edible insect products", comments Bastien Rabastens, member of the IPIFF executive committee in charge of food issues.
